They do have the possibility of becoming Departmental Members - though not the obligation to. It actually used to be expected of them - at one time, not so long ago, every Department would have a least one MLC Member who would be responsible for dealing with any legislation for that Department going through LegCo. The idea idea that LegCo is primarily a scrutinising body and its members don't take up Departmental posts is a very recent invention - more of less in the last five years.
