Kelly Posted August 19, 2004 Posted August 19, 2004 you got some good advice here gem, good luck with it, the landlord has no comeback here if he didnt give you a rent book, wonder if his fire regulations are up to date. All staircases enclosed? firedoors on every door in the flat? firedoors on every landing on staircase? big big fines if not. let us know what the office of fair trading say, they have lots of leaflets about your rights as a tennant and you have far more than the landlord, he cannot evict you without a court order and courts will not even order it unless there has been over 8 months of no rent paying etc. good luck
GEM Posted August 19, 2004 Author Posted August 19, 2004 The Office Of Fair Trading can only offer advice and their advice is to go and see a lawyer and that is it.
Observer Posted August 19, 2004 Posted August 19, 2004 Obviously I do not know the in's and out's of your financial circumstances etc, but from what you have said it sounds as though you may qualify for legal aid of some sort. It is fairly common practice for the initial discussion with a lawyer to take place without charge and during which time, how they can be of assistance (or not, as the case may be) will be established. If you think you may qualify for legal aid, it would be better to identify those practices who deal with that type of work, as not all do. Have you actually been given notice to quit? What formal paperwork have you received?
GEM Posted August 19, 2004 Author Posted August 19, 2004 Yes I had a notice to quit of the Landlord on wednesday afternoon to be out by next wednesday. That is the only paperwork I have received. I am not in a very financial stable situation at the moment neither which really doesn't help matters. I have got an appointment with a lawyer tomorrow morning so I will just have to wait and see what he says. Fingers crossed it is good news.
silky Posted August 22, 2004 Posted August 22, 2004 If your landlord is who I think he is (and I am only guessing by what you have said) the best advice I could give you is to cut your losses and find another place a.s.a.p. What has happened to you sounds very typical of the sort of thing this guy does to his tenants on a regular basis and has done for many years.
Ripsaw Posted August 23, 2004 Posted August 23, 2004 If your landlord is who I think he is (and I am only guessing by what you have said) the best advice I could give you is to cut your losses and find another place a.s.a.p. What has happened to you sounds very typical of the sort of thing this guy does to his tenants on a regular basis and has done for many years. <{POST_SNAPBACK}> I don't have a clue who the guy is, nor do I care. *If* he does do this sort of thing on a regular basis, then all the more reason to go through the system and expose him for the person he is. Why the hell is he "above the law"? By all means Gem should try and find another place as soon as she can, but she shouldn't be rushing to leave the flat until such a time that suitable alternative accomodation has been found and secured. Even if Gem has breached her lease (?) only a Court Order can force her to leave the flat.
