  5. Hi. im looking for an answer/advice about my current situation please. Earlier this month I went to work and was immediately summonsed to a meeting where I was given an immediate suspension, and according to my employer, this was due to an allegation of negligence. They would not give me any details about what the supposed negligence was, but gave me 2 options. Either, resign straightaway and receive notice pay, or face a disciplinary hearing which if it didn’t go in my favour, would result in instant dismissal with no pay at all. Despite my best efforts I still do not know what negligence they refer to. my suspicion is that my face no longer fits with the new management and staff, and that at least one, and probably more of them have concocted the ‘negligence’ issue and that my departure would be what they were trying to achieve. so confident am I that I have done nothing wrong, I had seriously considered opting for a disciplinary hearing, followed by taking the matter to Industrial Relations Tribunal should their numerous collective voices result in me found to be negligent and instantly dismissed. from a financial point of view I stated I would resign and take notice pay, as opposed to trying to challenge an unknown allegation. It is obvious I would not be able to continue working there with these people, given the manner in which this has been organised, and the fact there would be no trust or support anymore. all that said, we have now passed the normal salary payment day and nothing has been paid, even pro rota payment for the actual days worked this pay period. SO……. is withholding salary lawful? I welcome any advice or being pointed in the right direction thank you.
