What the hell has this do to with MHKs?

 

At the end of the day, it's between the travel agent, the airline and the passengers - and already covered by consumer laws.

 

Well the fact that it's got nothing to do with them has never stopped MHKs sticking their noses in before. I suspect in the current political climate such efforts will be met with as much contempt as thanks, but it's the way that the Cretneys of this world have successfully operated for decades and old habits die hard.

 

Any responsibility in this case will lie with the "tour organiser" in the first case, rather than the airline or travel agents, though the package operator may ask them to stump up if they have been negligent. Under which regulations is another matter. There are Package Travel Regulations dating back to 1992 in the UK and while these technically wouldn't apply in the Isle of Man, I think they do if your holiday was sold by a UK company or if it departed from there. Obviously these holidays didn't start in the UK, but other circumstances may mean that the regulations would still apply legally. It could also be that similar regulations have been brought in by Tynwald.

 

The 1992 Regulations were brought in to comply with EU regulation on package holidays (the sort of 'EU red tape' that everyone whinges about until they benefit from it). So even if the EU law didn't apply, there would be legal obligations because the holiday was in Madeira which is in the EU, even if the Isle of Man isn't.

 

In practice any experienced operator will have systems in place to assess and arrange compensation in this sort of situation and there will be all sort of precedents about what sort of payments should be made for what sort of delays and inconveniences occurred. After all there will twenty years of experience in the UK of what small claims courts will award etc. So except for the people who are expecting the moon on a gold plate, it should all be sorted out fairly easily.
