'Closed Road' Driver - Cleared

On The Bus

This is great news:

http://www.iomtoday.co.im/article.cfm?id=54119&headline=Marina businessman cleared of driving on closed road&sectionIs=news&searchyear=2020

Hopefully there will be major repercussions for those responsible in bringing this case to court and the potential for the drivers name and good character to be besmirched by this whole charade!

It must have been truly humiliating to have been arrested at his home address, possibly in full view of his family and neighbours?

The TT Mafia will be fuming from this result!

Joe Bloggs would have been fined £1000 plus costs and received 6 penalty points, at least.
As long as one has a “good excuse” to be on closed roads , all is ok then ?

An almighty fcuk up if you ask me.

How much has this little fiasco cost the taxpayer?

If there was supposed zero tolerance etc, there would have been a conviction. When it suits the IOM, especially if it relates to financial crimes, then its throw everything to make sure something sticks. The words of a former chief minister come to mind, prior to sentencing ‘the eyes of the world are upon the island’.

Or the reason that perhaps the road wasn't as 'closed' as the TT brigade would have us believe.

Roads are closed legally by the time on the clock.
If this guy wasn’t having his arse licked by Gov. over their belief that there could be money in it for them from a marina being built, the outcome would be different, in my opinion.

The only way you will see a marina in Ramsey, is if there is a Marina doll from Stingray, on sale on the Drop In shop !

False.

They also need to have the necessary signage and barriers in position.

This was highlighted a few years ago when a chap decapitated himself by riding into a rope that had been strung across a 'closed' road. Now they have to stick little flags on them.

Pretty sure they all had red flags on years ago. At least they did when I marshalled.

The reason the roads are officially closed at say 6pm is that Travelling Marshals begin a sweep of each sector to ensure barriers are in position and parked cars are off the course before practice begins. They are aware that people can become 'trapped' between junctions and would be riding accordingly. Roadside Marshals also begin a sweep of their area to make sure that there is no debris in the road so it's possible they can be put in danger by someone trying to get to their destination late. I believe that this guy ignored the Marshal's instructions and just batted on. If he had collided with someone when the roads were officially closed, who would be responsible?

At one time Marshals were able to use their discretion, now they are not able to do that. We have all seen serious incidents where things have gone wrong when individuals take it upon themselves to make decisions. The Marshals have not been supported in this case, less serious cases have been dealt with far more harshly.

We'll have to wait to see the actual judgment to see the Deputy High Bailiff's reasoning and whether this has wider implications.  It's surely a coincidence, but the fact this has come out the same day that it has also be discovered that the guy is in discussion with the AG's Office over the Ramsey Marina, doesn't really look good does it?

The emphasis is on the oraganisers to ensure that appropriate (and required) signage is in place. Did the car ram the barriers and signage out of the way?

To claim the marshals weren't supported is a bit removed from reality - was this case not taken to court? Unless you are perhaps suggesting something untoward has happened with this verdict?

It's possibly a good job they're no longer allowed to use their 'discretion' - making decisions that (as amateur) they are not trained to do.

I would suggest that the only "mafia" relating to the TT are those hell bent on stopping it...

You don’t have to be a big fan of the TT to appreciate that the marshalls need to be respected 100%. Too many people these last 20 years or so taking the piss by either walking across, riding or driving on throwing objects on and recently holding out selfie sticks several feet into the closed area

All these things have to stop now and everyone has to understand the potential for disaster when people think they know better than the marshalls and organization
