Summerland is not "family silver". It is a useless, defunct site unless someone puts it to some use which, it would appear, will never be the case while it remains in government ownership. Might as well get something for it.It is 'family silver' in 2 senses IMO, in that: 1) that they could encourage leisure facilties to be put on it benefitting the population at a subsidised cost, as there is far from a business plan (with a reasonable cost/benefit) that would encourage a business to build such facilities) and 2) the money will likely just be absorbed into the general budget and spent only on maintaining a bloated civil and public service and wasted - instead of having to face up to cutting where the money raised will otherwise support. Buster Lewin Posted November 11, 2014 Share Posted November 11, 2014 Having Heads of Agreement in place, is only in favour of the developer, in other words it gives him exclusive rights to negotiate on every point he wants. I would hopefully trust Govt has a fixed deadline included in the Heads of Agreement, and it should be a short period, no longer than three months. The issues that need to be resolved in this period of exclusivity is to determine any clauses etc that both parties require to be included in the Deed of Sale, including the price. I can see what will happen here is that Heads of Agreement has included a significant time period, which will allow the Developer to wear down the Govt to get what he wants, then out pops an Option to Purchase subject to obtaining planning permission, which will build at least a further two years to ensure the Developer can be assured to have carried out all steps available to him. Then and lets say this period is 3 years from now, the Developer will then take solely a commercial decision as to the state of the market at that time, if he doesn't believe the market is then suitable for the proposed development, then the Developer simply does not extend the Option to Purchase, therefore no sale. The other plus for the Developer is that when the one developer has exclusive rights to the purchase of the site it prevents any other competitor coming into the market place, especially when the developer has other sites under his control that he can release now or at any point of time for development when he believes the market is strong enough and the demand is there.
