Specialist trademark lawyers will usually seek the instruction of clients before engaging in potentially expensive legal action. Most minor breaches will be resolved by a letter and discussion between the two parties. I very much doubt that a letter would have been sent without instruction from the client. I also suspect that, despite this being brought to the attention of the public, like most of these issues (which remain a private matter between the owner and person in breach) it will be resolved sensibly. I would guarantee that the lawyers and DED routinely deal with many such matters and that these remain confidential. There is no value in taking such matters to the media as they are simple matters of law and registrations. Opinions and appeals to the public matter little in resolving what is essentially a straight-forward commercial rights issue.

In that case Boredom you didn't get the gist of my earlier post. DED has to act, like any trademark owner to protect its rights by preventing unauthorised use. I would imagine that Bushy's registration of Bushy's TT went unnoticed, which would be an error. However, as DED registered the TT for use in connection with the IOMTT some years earlier, their rights will probably take precedence. There is nothing stupid about taking action to protect your trademark registration. It would be stupid not to.

 

If DED took no action and lost their rights to the TT name and logo as a result, I am sure they would be vilified on this forum and elsewhere. Bushy's would not be trading at the TT at all if the trademark owners did not have the revenue or rights to run the event. I am just trying to explain trademark breaches and subsequent actions. I don't really care if the TT exists or not, so I am not toeing anyone's line. But please feel free to ignore what I say and pursue your own opinion.

What's the latest update regarding the legal dispute between Tiny Cow and DED for the Jacksons and Tom Jones Concert? I'm sure there will be payout before long. Perhaps Rob Callister can give us a progress report? What's the latest regarding Vision On? Jeez with all these potential legal cases on the boil, you think DED lawyers would have their hands full, instead of looking to harass hard working members of society. A previous poster says Bushy should pay a fee - why should they? I'm sure they pay tax, and NI, as well as employing people. Are we going to harass businesses which advertise TT Breakfasts, TT Specials? For the sake of a few quid. Things must be that desperate,

I agree with most posters that Martins done more for the tt tourism than the bunch of losers we have in d.e.d

Mind you he is a businessman who risks his own money not in a cosy government department who just throw our hard earned away like confetti, am sure any problems could have been discreetly discussed with Mr B and sorted, without all this fuss or do they have a hidden agenda against Mr B. Just for balance I've never acquired a taste for bushys ale although the Norseman larger is okay.
