The legislation simply states food and drink so they haven't legislated a difference or quantified what is essential food and drink 

There could be an argument to say going for an ice cream is not essential travel but that would be going beyond what the legislation says

And whilst it seems a logical step to start quantifying that (aside from the urgency of the lockdown legislation requirements) I think that would be like opening pandoras box for government overstepping control on peoples dietary choices

Exactly Rhumsaa. You’ve identified the tension in the Regs. One set saying who can or cannot open their business, Davison’s always could. The other saying who could leave their homes and for what/when.

It would appear that McDonalds themselves chose not to open just for drive-thru takeaway

Perhaps they thought it more financially attractive to close all operations, put  the staff on 'furlow', & claim any cash available from the UK government schemes

They remained open for drive through and walk in/out takeaway initially, they'd only closed the seating areas off and marked queueing points out on the floor.

Someone has put a photo on Facebook and notified the police about people disrespecting social distancing outside the ice cream cabin.   The photo has been taken from an angle from behind which looks as if people are standing close together some sad idiots around.

There's a lot of it around.  A lot of it in 'respectable' papers.
